The cop "threatened" to do a search so that they would give up the phone they were lying about keeping. To me that sounded like a bluff and the cop knew the kid was lying about having the phone. Keep in mind that Jones noticed the kid was nervous/guilty so I'm sure the cop did also.
Even so....wouldn't the probable cause be that Jones claimed that this specific car had his property and it wasn't being returned? It's not like the cop just randomly picked some car and started harassing them.
The physical violence is a little much but I don't have all the details or know what was going on with the cop/driver.
I mean, Jones was admittedly operating at less than 100%, so it's the word of an intoxicated guy vs. the driver. Again, Jones was right, which is awesome, but this irritates me on principle.
The average person doesn't know they can refuse a search, and the cop totally used that against them. I hate that sh*t.
I'm definitely with you on that. I hate the way cops can (and will) go past their boundaries on searches. Personally, I have hated dealing with cops who will easily abuse their power. I had one instance where my car was very illegally searched, like one cop distracting me and talking on my drivers side while his partner opens the passenger door and goes into my glove compartment quickly.
The thing is, they found corn on me but only personal usage amount so they let me go free (after dumping the corn, that is). They thought I was "trafficking weight" or something cuz I had long hippie hair, a tie dye shirt, and just walked out of a shady bodega so they figured they could intimidate me, find the weight, and be big heroes but once they only found a bowl or two they realized they made a mistake and drove away with no ticket.
In this case, based on what I know, I feel like the kid should have just given the cop the phone he found. It's possible the cop was a d*ck with a short temper and stepped over the line and it's also possible the kid was being difficult to avoid getting in trouble. Probably a combo of both.
I haven't had much experience in refusing searches (the one bigtime search was started before I knew what was happening) but I have heard stories that if you refuse a search it'll make things more difficult. Like they may hold you and bring in dogs (if available that is) and then all they need to do is say "Ohh..see...the dog is smelling something so we have to go in". Have you personally refused searches? I've always been curious about personal success stories.

I have refused a search. They made me wait 30 minutes until dogs could be brought in. I had nothing on me. I have decided in the future that I will allow searches since I will never have anything on me. I would prefer not to waste my time.
Modest Mouse's first 3 LP's are all really really great. The Moon & Antarctica is probably the most accessible of the three, with Lonesome Crowded West being my personal favorite.
However, it being a (relatively short) festival show you'll probably hear 2 songs max from This Is A Long Drive...(their debut) and LCW. At least that was the case when I saw them a few years ago, a show I thought was pretty mediocre. I've also heard they can be hit or miss though so maybe you'll catch a great one.
I saw them in 2006 when they played a run of club dates in New York to test out We Were Dead material with Johnny Marr, and it kind of sucked. They only played 3 songs that pre-dated Good News. It soured me on the band for a long time, although their setlist at Pitchfork '10 was much better.
However, it looks like Brock has been reintroducing a lot of older material over the last couple of years. Dark Center, Broke, Breakthrough, Custom Concern, Cowboy Dan, and even Sh*t Luck made multiple appearances last year. www.setlist.fm/stats/modest-mouse-73d6ae69.html?year=2012

I saw Modest Mouse this past summer. The set list was great. Played a lot of old songs and some rare ones that I didn't think they played anymore. The show was pretty energetic and Brock seemed really into it. The only bad thing was that they were pretty late coming onto the stage, probably at least 25 minutes. They did make it up with a pretty long encore, if I remember correctly, but still their delay didn't start the show off well. That said, I would love to see them again and I doubt they would show up 25 minutes late at a festival.
Have you ever refused a search before? Or have friends who have? Just curious.
Honestly I had so many run ins with the fuzz in high school and college I really can't remember. I never had anything on me, but odds are there was one or two times I told them to go f*ck themselves on principle. Never had my car searched but have had my pockets turned out more than once.
Edit: That might not make sense but there's nothing that tees me off more than being accused of something I didn't do. I get super indignant.

On the way to Bonnaroo this past year my car was pulled over for "following to closely". The officers approached the car and went into this big ordeal about how they had already busted tons of people, and that to them Bonnaroo was simply a NO NO WORD!!! fest. He even said he could smell corn (which was BS & he knew it). He explained that if we admitted to having anything on us we would be given a citation; however if we denied having anything they would search the vehicle, and book us if they found anything.
I tried explaining we were going to Bonnaroo for the music, obviously he didn't care for that reasoning. When I told him there was no corn here, he asked to search the vehicle....at this point I was extremely nervous but decided to make a stand. He asked to search and I told him there was no probable cause, so he said he would bring a dog. Within 5 minutes a dog came and did a few laps but luckily the dog didn't hit anything.
The first thing the dog did was run over to a pile of rocks and start sniffing them; I'm pretty sure the dog might have been broke. Regardless, the officers then said ok you can be on your way, after flashing in front of us about 4 bags of confiscated drvgs / stash cans from other people. I was terrified I was gonna spend the weekend in Tennessee jail.
Edit: I also had friends who were pulled over with nothing on them. They allowed the search and had every single thing removed from there bags, and weren't able to leave for about an hour. So if you're clean and they can get a dog there relatively quickly it might be better to refuse.

Only asked because anytime people bring up the "You can refuse a search....they don't have a right to go through your car" I like to hear personal stories to get more context. Sometimes it comes off like "You can just refuse a search and they will leave you alone" when there's typically a lot more to it.
As I said, I don't have much experience in refusing searches but for most of my friends who have done it, it hasn't turned out great for them. They obviously were breaking a law if they got in trouble but there weren't many instances I personally know of where refusing a search helped. I do think it's important for people to know. I just choose to not drive with anything illegal as much as humanly possible. Too many close calls.

Yeah, if you're caught you're caught, be a man about it. Being an armchair legal scholar won't help you in that situation.

Actually the cops were really chill and relaxed when I approached them. They definitely weren't hounding anyone. It was the conversation between the two which provoked the officer. Guess he didn't like being lied to. Regardless of the tactics used I was just happy to regain my property. Disaster averted.

I'll be there for W1 and W2. I was originally planning to sell my W2 ticket... but ehhhhh I'd think I'd rather goto both :-D. Plus I have a lot of non-inforoo friends that will be there for W2.
I know it will be hard, but I am really going to strive to not repeat any bands. We'll see how it goes.
I don't think it's worth starting a new thread, but do we have a running list of who is going to which weekend? I'll compile it then maybe Juggs can throw it in the OP. Or not. Just thought it'd be useful. I guess the real question should be..
