It has been argued that Ken Kesey and the Merry Pranksters present the Acid Test is not an act but a touring party with its own lineup and not eligible to be drafted.
Edit: Updated the name of the act drafted in the body the post. It was originally posted just as Ken Kesey's Acid Tests. (It's too long for the subject of the poll.)
My argument: the Acid Test were parties/events, not a performance. Per Wikipedia
The Acid Tests were a series of parties held by author Ken Kesey primarily in the San Francisco Bay Area during the mid-1960s, centered entirely on the use of, and advocacy of, the psychedelic drug LSD, also known as "acid".
Kesey and the Merry Pranksters organized it; they were not performers. Unless you consider taking a bunch of drugs and geeking out to the music playing to be a performance, in which case we are all performers on this blessed day!
The album "Acid Test" that Maddog is likely to refer to was recorded at an Acid Test and contains a lot of interviews and ramblings of people on drugs. There's a little music too, but nothing suggesting that "Ken Kesey and the Merry Pranksters" is an act with anything resembling a discography (much less one that they've performed). It was never even intended to be released or sold.
My main argument is that party organizers aren't an act, and I haven't seen any evidence of "Ken Kesey and the Merry Pranksters" performing anything.

I said yes since I don't think this is that different than Andy Warhol.
I feel like this is much more akin to the ineligible Exploding Plastic Inevitable than Andy Warhol. It's an event showcasing a music acts (Grateful Dead etc in this case), just as EPI was voted to be. The Andy Warhol that got approved is just him displaying his paintings gallery-style, which doesn't seem similar to this at all.
