You need to set up an appointment with the victims rights coordinator at the court house. Her job is to listen to your side of the case. They are very friendly and helpful. I am not sure if you can just get out, but the person you speak with will be able to tell you yay or nay. Plus talking to them will make it possible when you do have to go to court for her to call when it is your time to go to court and not have to be there early in the morning like the old lady will have to.
I work in auto insurance so I dont think you even necessarily need to go to court. The lady is likely just trying to get out of her ticket for something like "following too closely". If your damages have already been paid for and settled then there is no dispute on liability and she likely just is trying to get out of the fine. I dont think its anything that you MUST attend. But obviously its a case by case situation
I am not a lawyer (maybe PM Juggs/Chris Hansen), but I am pretty sure you cannot be compelled to testify without a subpoena. I would just call the Sheriffs Office and say you cannot that day because of prior commitments, however if the prosecutor thinks your testimony is important enough to get a continuance you would be happy to reschedule.

it is a subpoena, the back reads "If you fail to appear you will be subject to arrest and prosecution pursuant to the Louisiana Code of Criminal Procedure, Articles whatever and whatever, blah blah"
i as well feel like its not as big of a deal as it seems, and would gladly skip this court appearance if that is what it comes down to (no way in hell am i missing my beloved, and PAID FOR, bonnaroo), but i am hoping to avoid as much Leno as possible

I'm not a lawyer in Louisiana. So please understand this isn't legal advice. But if I were you, I'd call the Sheriff's office and tell them you've already paid to be on vacation in Tennessee that day. (I probably would avoid mentioning Bonnaroo unless they specifically ask.) If they want your testimony badly enough, I'd think they can reschedule the hearing. Be polite but firm with them. Tell them you're happy to cooperate and do your civic duty. But you've paid for this vacation already and you've gotten the time off work. And besides, you're the victim here.
Court hearings get delayed and rescheduled all the time. Just call up the courthouse and tell them you have a prior committment. I can almost guarantee you that they'll reschedule.
What was wrong with my advice? You could have be done already. The sheriffs office has nothing to do with failure to appears, unless you have failed to appear. Talk to the victims rights coordinator.

We learned from our off duty sheriffs how to do all that. Its really simple. Basically the only way to get out of this subpoena. So jibber jabber on tv boy.

He is a lawyer, I am guessing he has the info straight.
I am not licensed to practice in Louisiana, but I am lawyer/Admin Law Judge in Oklahoma. What Hansen has said is correct. There should be a phone number or contact information on the Subpoena you received. If not, call the Court Clerk's office.. either municipal or district. Explain the situation to the Clerk and ask them to assist you. They will connect you to the proper folks.. Which more than likely will be the City or County Attorney. Be polite, but firm that you have expended a great deal of money for your vacation, that cannot be rescheduled. Stress that you are willing to testify, but at a later date... but be sure you get them to release you before you do skip the Court Date...
First off Juggs gives enough people hell. I know for some reason I bother the shit out of him so I keep messing with him..Plus he said some shit bout my mom and she is crippled. If she was in good health I could take the joke but jeez...
I agree with you both about that, but taking my advice he can also come into court after roll call on the later date if/when he decides to go which is pretty nice if you ask me. The lady will call him when its time on that day. I bet its something lawyers hate... to wait on a witness. As someone who has waited for lawyers in court many times please take your sweet time getting over there. Here's to coming in late after Roo!!
