It was a partying troupe that went to multiple cities, not an act. The album is a series of interviews with Kesey et al conducted at an Acid Test, and was not originally intended for sale or general release.
If your argument is that a group of people who threw public parties in multiple cities should be considered a draftable act, then I challenge the pick.
Edit: Especially because most of the posters for Acid Tests display a lineup of the acts who will playing, which is further evidence that the Acid Test is an event, not an act itself.
