1) They are simply The Grateful Dead with different members playing Grateful Dead songs and not a new entity. 2) The selection of Bob Dylan & the Grateful Dead eliminates any other iteration of the Grateful Dead with a different singer.
The defense appears to be that Dead & Co is its own entity and has several different members from the classic line up of the Grateful Dead.
2. I don't understand why Bob Dylan and the Dead would eliminate The Dead with John Mayer. If anything that being drafted sets a precedent for why this should be able to be drafted.
Half the band is different, and they have a different name. People are smart enough to know what the difference is.
I think that the argument against that is that a) the name obviously ties it to the Grateful Dead and b) their set is almost exclusively (if not actually exclusively) comprised of the Grateful Dead's back catalogue.
The only way they get away with that is because the Band contains former members.

It's the Van Halen rule. VH with DLR = no VH with Cherone or Hagar. The Grateful Dead with Jerry Garcia has already been selected.
(Garcia was still there with Dylan so it was a joint think, pardon the pun.)

I mean VH released a ton of music with Hagar and a lot of people think it’s the better iteration. I think someone should have van hagar if they really want it
And instead of saying all of your goodbyes - let them know you realize that life goes fast - It's hard to make the good things last-you realize the sun doesn't go down - It's just an illusion caused by the world spinning round

But this isn't two different lineups of "The Grateful Dead". It's Dead & Company vs The Grateful Dead

They cannot. That was established from day one. A lot of acts are getting pretty diluted and we aren't even a third of the way through.

This isn't what the crux of my argument is, but there are other cover bands that have Dead in the name that don't have actual members of the Grateful Dead in them. Those should be allowed, too, imo.
Cover bands are fine. They are different acts than the original band. They will be billed as such. People can look at the lineup and see a cover band and know it's not the real thing and they can decide whether that's a cool addition to a lineup or grounds for mockery and derision. I'm sure plenty of people think it's plain stupid that I drafted Dead and Co because the Grateful Dead are out there already, not because of exclusivity rules, but because they might find it to pale in comparison. And that's fine. I just think that it's a different thing than the Dead that people are knowledgeable enough about to make that decision on their own.

I don't think Van Hagar should be allowed because they didn't call themselves that. They called themselves Van Halen. A lineup poster wouldn't make the distinction. They replaced a member. AC/DC had Axl in it for awhile. They called themselves AC/DC. That shouldn't be allowed either. Also, that's clear in the rules. That was decided and agreed upon prior to the draft. That's not what this is.
