i'm voting no, mostly on principle. if the yeses do end up having it, i'd prefer this to be an isolated ruling and not set precedent. reason is because many phish songs go together, and saying the horse and silent in the morning count as one song could mean well i can't have TMWSIY without Avenu Malkenu, or I can't have Alumni Blues without Letter To Jimmy Page, or I can't have Mike's without Weekapaug, or I can't have Forbin's without Mockingbird, or i can't have HYHU without Love You.
and i get it, the horse is ONLY ever played preceding silent in the morning. but it's still a separate song, and silent is frequently played sans horse.
actually you know what fuck it changed my vote to yes. i don't want to shit on Ambassador Of Fun's draft board for no reason other than self-congratulatory smarminess, and getting the horse before silent rules live.
This is the only one. It got brought up before the draft in the Phish thread when I asked and it seems like they're paired basically every time aside from like random acts of God.
