Artist Nadia Plesner created this image to satirize the lack of media attention a genocide like Darfur gathers compared with the relative overexposure of say, skinny white women with little dogs and designer bags.
Louis Vuitton has responded with a lawsuit demanding that Plesner stop producing the image (which appears on shirts and as a poster print) and an additional $20K per day in damages for copyright infringement.
The fact that there is a good being sold with this image will probably make the artist lose the case. If only because of the sheer amount of money to mount a proper defense.
If it were just a painting or if it were something that was being distributed free then I think this would not be an actual case of copyright infringement (in the US).
F*ck Louis Vuitton. I can't think of anything more selfish than suing over something like that. How bout he contributes 20K a day to the cause, instead of trying to stop this gal's plight for the less fortunate and dying

I don't think it's copyright infringement unless they are actually using something the company has trademarked. If they're going with "Simple Living" instead of "Louis Vutton," I don't think that would make LV's claims actionable.
Though, selling the image on a shirt instead of just using it to make a social/political statement does make the defendant look suspicious.
"Though, selling the image on a shirt instead of just using it to make a social/political statement does make the defendant look suspicious. "
Not really because the artist says on the website that "100% of the profits from the Simple Living t-shirt and poster are donated to Divest for Darfur."
I understand why the artist picked this bag - it's very recognizable because of all of the logos. If she had used the Balenciaga motorcycle bag, most would not have gotten it - it's just a large bag. But the LV logo used on this bag has been repeated over and over again so it's very obvious what it is.
But then I also understand why LV is so upset. Why are they being singled out instead of Balenciaga or Hermes or another designer with expensive bags? It's only because they have such a recognizable logo, not necessarily because they are anti-Darfur. Yet those who care deeply about Darfur will boycott LV just because they are being used in this ad - even if the lawsuit never came about.
It doesn't say LV though, it says SL. If knockoff bags are allowed to exist that don't say "LV" and not get sued for copyright infringement, why should this get sued?
