this comes up every year, but i'd like to bring it up again, due to the fact that i see people being pulled over and searched by the Tennesee police every year.
my friend showed me this website the other day, explaining your rights when a police officer pulls you over, and it even has a printable sort of cheat sheet to help you if you are ever in a situation where a police officer has pulled you over and has asked to search your car

This is really important in my opinion. I think it's absolutely disgusting how police have a tendancy to ignore our rights because they think, and are most often correct, that we don't know these rights, just so they can arrest us unneccesarily, and recieve a raise for it.
But I think every individual should know their rights, and excersice them. I'd love to tell a cop "I do not consent to this search" have them drag me to the station, and then have them find NOTHING just to see the frustration on their faces.
Thanks for this thread! I know it's immaterial, since there are no drugs at bonnaroo, but I live in Nashville, and the boys in blue can be hard a**es here sometimes. Good to know your rights.
Respect your policeman, they are there to protect you. That bieng said, a small suggestion is to abide by the laws while driving on the roads. I mean don't do anything stupid while driving to Bonnaroo like speed or drive under the influence, you could get pulled over or go to jail or hurt yourself or even potentially someone else. Have fun and also hide things well and keep them private not public!!!!!

Absolutely. I don't condone doing stupid things, but I know they're going to happen, obviously. If these things much happen...keep it your own business...and just generally be smart about things and everything will be okay.
Obviously, if you have drugs or something on your car, don't be stupid. Doing something like speeding when you have drugs on you only risks you getting arrested and might keep you from attending the festival you've been looking forward to. But reguardless of what you choose to do, you should know your rights, and the video above details them extremely well.
well, you ask me why i'm drunk all the time it levels my head and eases my mind i just walk along and stroll and sing i see better days and i do better things
if a cop ever asks you "can i search your vehicle" and you say "no" he will inevitably ask "why not?" the correct respeonse to this is " because I choose to excersise my right to say no, if I can't use my right to say no, then what is it good for?" at this point the cop will prolly say something like "step out of the car for your beating". haha, but for real, it's your right to say no and that is excuse enough.
I would respond with "Because my lawyer advised me to never consent to a search". That should be enough to inform the PO you are aware of your rights without needlessly antagonizing him.
I always have my lawyer with me to rescue me when I get into trouble. His name is Dr. Gonzo. I think he's samoan. It doesn't matter though, does it? Are you prejudice?

The police officer doesn't need permission from you if he has probable cause, and honestly....he can create "probable cause" from many, many things. The best bet is to just keep stuff hidden, and give into the search. If you give in, he'll think you don't have anything to hide, and would probably just glance over things and send you on your way. If you deny him right to search, he can and probably will find a way to search, regardless and he'll search thoroughly...because he suspects something now.

No No No, NEVER EVER EVER Give in to the search, whether you have anything on you or not, DO NOT allow them to search your car.
If you "give in" to the search, the WILL NOT just glance over and let you go, not here in TN anyway, they will tear your car apart, and when they find nothing, they will tell you to have a nice day and leave YOU there to pick up all your stuff that they pulled out!
If they must harass you and make you let them search, then they have violated your rights and anything they find is inadmissibale n court!
Do not give in to the search, ESPECIALLY if your are on the way to roo, they WILL search you down!

As soon as you consent, it's a valid search and your lawyer cannot challenge the legality of it. It's true, if they want to tear your car apart, they will do it for a valid reason or not. But if you don't consent, the basis of the search (probable cause) can be disputed in court and you stand a much better chance of getting the evidence thrown out. Any competent (IMO) defense lawyer will say the very same thing - don't ever consent to a vehicle search.
Probable cause validizes a search as much as owner permission does.
I've personally never heard of cops giving someone a hard time after they consent to a search. But I have heard it often after someone doesn't consent. Believe me, if you don't consent, they'll find a way and a reason to search. And if they find something, they'll also find a way to legally use it in court. They do it all the time. Loophole make the world go around.

thats not so. they will rape you no matter what if they want to. they dont go easy becasue you give them pernmission. and there is a huge difference betweeen giving consent and them finding prrobable cause. probable cause has to be proven. consent is on video tape. many many cases have been thrown out for illegal search and seizure. to each their own. but contact a lawyer and ask them if your still questioning what you should do. every lawyer out there will tell you dont consent to a search and dont answer quesiton.s do what the law require you to answer. present id, registration and insurance and leave it at that. your not required to answer questions about where you are going or what you have been doing tonight. these are tactics police are trained to use to screw with you. just dont play that game. if they are really busting your balls about something tell them you want to speak tou your lawyer. the only reason they bust your balls is to get you to answer a question or consent to something you dont have to. cops dont ask for something unless they need something they dont have. if they have probable cause they dont ask. they ask to trick you. i know everyone is scared to say no to a cop. its all part of the brainwashing in america. know your rights and exercise them. contact a lawyer and ask them. its much better then taking info off the internets. i assure you a lawyer will tell you not to consent and not to answer questions. in fact most will tell you to only crack the window enough to give them your documents and dont answert any questions outside of identification and automobile documentation. it seems like it will just piss them off but it actually lets them know that you know your rights and your not gonna give them an in. but in the end the nazis have near absolute power and they will do everything they want to. but dont make it easy for them. and cases do get thrown out all the time for cops not following the laws.

But only one of them can really be debated in court to your favor. Personally, I know several people who consented and had their cars tossed and one of them was completely clean. You give yourself absolutely no advantage when giving consent.

They're tricky bastards. Cops sre good people, but their jobs are present so people get arrested. Let us not forget that it is our terrible legislation of government in this country who makes cops act like this and puts forth the image of how cops have all the power. I'm not saying what cops do is right, but if we ever want these incidences to end, we have to petition our state government.

Also if you are going to carry something, don't put it somewhere obvious. Glove compartments, under seats, in bags, in your pockets, etc. are the first places a police officer will look. I suggest getting something similar to these products:
well, you ask me why i'm drunk all the time it levels my head and eases my mind i just walk along and stroll and sing i see better days and i do better things

Please, please, PLEASE, NEVER consent to search people. This is horrible advice. This is the reason the system is so screwed up as it is, and the idea a cop will do a less complete search because you consented is absurd. No offense man, but you are confused. Probable cause is only something they need to give to a judge to get a warrant if you DO NOT consent. And not consenting is not probable cause, just like it says on the NORML site. Regardless of whether you're riding dirty or not, NEVER CONSENT TO SEARCH. If the cops knocked on your door, would you just let them in because "you have nothing to hide"?
I've been pulled over a few times, have never consented to search, and have never gotten in trouble. I've spent more time on the side of the road then I wanted to while they ran me and my friends ID's, but in the end we were let go by asking "Are we under arrest? If not, we wish to leave". NEVER CONSENT TO SEARCH. Cops are counting on you to be nervous and compliant. Be calm, be firm, be respectful, but never consent to a search.
Far more useful than my rant, I thought I would share my experiences with the board.
Instance 1: Going from Little Rock, AR to Memphis, TN to see Phish at the Pyramid with my girlfriend. Got pulled over by one of Tennesee's finest not long after crossing the bridge for changing lanes without using my turn signal (Doh!). Officer asked if I had anything in the car, I told him of course not. He asked if I would mind if he looked through the vehicle. I told him no, when he asked why not, I simply said that's a right I do not wish to waive. After running both me and my girlfriend's ID's, he simply let us go with a warning on the turn signal. End of story.
Instance 2: Going from Little Rock, AR to Salem, MO for Schwagstock with three other friends. My buddy had things he shouldn't have had in his backpack. Got pulled over in Cave City by a couple of AR State Troopers for doing 10 miles over (Doh! again). This guy was more of a jerk than the TN cop. When asked if he could search the car, I told him no, when asked why, I told him I didn't want to waive any of my rights. He took our ID's to run, and told us to get out of the car, which we did. He searched us (and found nothing), but not the car. After being on the side of the road for over a half hour, I asked the other cop if we were under arrest, and if not we wanted to leave now. Then the first cop gave us our ID's and me a ticket (which I paid on my way back home), and let us go. It was a hassle and it sucked, but we were able to drive away without having the car searched.
I suppose it's important to note that we all had squeaky clean backgrounds. But know that cops rely on people giving up their rights, it's really the only way to catch small amounts. They know your rights. You should too. Even if you have nothing to hide, you shouldn't consent to a search. You're just feeding the flames. No warrant = No search
I also remember seeing an episode of Cops where the cop asked the guy if he could search his car and the cop found druqs. The cops asked the guy "If you knew there was druqs in the car, why did you let me search it?"

Yea, ive had my car searched once(clean), they asked me and i said they could cus i'm an idiot, but I live around Murfreesboro and this place has recently become swamped with da fuzz, It seems like the force just hired a bunch of power happy , ignorant, gun totin guys who just like to get into everyones buisness during the countless traffic pullovers they do after 6 pm every day. I saw two cop cars, lights flashing, behind some oldsmobile they pulled over (usually means a possible drug bust i guess) but the person behind the wheel was some really old lady. i dunno i just don't get it. I know the cops have a job to do, and it's a pretty tough one at that, dealing with criminals constantly makes them act like criminals, and treat everybody like liers and criminals.
funny story:one time the police were at my apartment due to some noise complaint which was total BS and said they smelled that smell, idunno if they invited themeselves in or my tarded brother said they could but what they did was warrentless and illegal, soon they were knocking on the door to my room at one in the morning. I'd normally be sleeping at this hour, but i had a lady guest keeping me busy. This officer lady walked RIGHT INTO MY BEDROOM exactly 4 seconds after I was finished, and naked Nacy jumps off of me in a panick taking the condom WITH her and pacing in circles trying to find some clothes(the cop has swiftly left my room at this point) .... it was such a messed up thing to happen. (but it's the funniest thing to probably ever happen to me so far, i think about it at least once every other day and laugh about it) and the moral of this story is mind yo buisness. and do yer job right, or else you might get an eye full of hot sex you won't be able to wash out of your eyes. thease cops around here don't go for the big fish, they meddle around in everbodys buisness looking for that small possesions charge so's they can make money off of the endless probation scam they got going right now.
