I have no problem with consenting to a search if I have nothing to hide...thats just me...I'm just one guy...
well thats good. i dont want to argue with you or anything. to each their own. but what right does a stranger have to go through your stuff if you havent done anything wrong? and they are not gentle. all of your stuff ends up on the hood of the car or the side of the road in one big pile. they pull your car apart. and then they just say ok have a nice day and leave you to clean it up. being a cop dosent give someone the right to waste 45 minutes of your life and mess up all your stuff.
can i go through your stuff? i like to take little glimpses into peoples private lives. come on man... you got nothing to hide!!
to each thier own. but a cop is nothing more then a low payed entry level employee. someone you probably work harder then and went through more schooling then. but because they have a gun and a badge its ok for a complete stranger, who has no legitimate reason to search you, to toss you car? just becasue you have done nothing wrong and they asked? again im not trying to be argumentative. just curious as to your thought process on letting strangers go through your stuff for no reason.

Even if I have nothing on me, I still exercise my rights because, if I never use them, what's the point of having them? I wasn't given rights with fine print that said "only use if you are doing something illegal"...

NEVER consent to search! even if you have NOTHING to hide! the constitution was not drawn up for nothing, and we should all exercise our rights as often as needed. if you have nothing to hide, then there shouldn't be any reason for an officer to ask to search your vehicle in the first place. just because you're headed to a festival DOES NOT give police the right to search your vehicle. please don't let officers of the law take advantage of you.
There was a lot of this talk last year about how you dont gotta let them search. All im gonna say is, its easy to talk that way until it has happened to you, If a cop wants to search your car he is gonna search it, lets not forget cops are LIARS, they are not gonna go walkin back to their car with their "tail between their legs", the last thing you wanna do is get smart with a cop(especially if you are from outta state), and start reciting law and you rights. Cops like authority and telling people what to do, my lawyer once told me basically once they have found something illegal, the judge could care less about the legalities of the search, checked on this after I got busted with 10 dollars of bud last year at the gates,(ticket cost $1400)now if they searched and you didnt give consent and didnt find NOTHING then you have got something. WHich brings me to my next point, Profiling, cops do a lot of profiling, 80 percent of people going to Bonnaroo smoke pot, cops know this, this is how they got me, the people they pulled and searched behind me were dreaded hippies, there are a lot of clean cut sometimes sober people that go to Roo, these were not the people they were pulling out of line, they were pulling obvious long haired pothead hippies. There was no questions asked we pulled up and the DTF(Drug Task Force) said step out of the truck we are gonna have a look around, then there were three big hick cops and two girls who searched my truck. they were obviously not gonna stop searching until they found something and after 10 minutesthey found that little bit of schwag i had and they were pissed. Dude, I was brought up to respect teachers, firemen, mall security guards, and police officers to name a few. Until they give me a reason to not to, I will. If a policemen asks to search my car, I will let him. I have found that MOST, but not all, people that get upset about this are upset because they are breaking the law and obviously don't want to get caught. All these people that are calling the cops liars and generally berating them I just have one thought. What happens if those cops aren't there to watch your chilrens's school? If they are not there to bust drug dealers that want nothing more than to sell your child drugs? When your house is broken into by some maniac? When the next Ted Bundy is on the loose? Just a thought. You should thank your local police officer next time you see them. They are not always right, not all of them are honest or model citizens, but we need law enfrorcement to keep us safer....bot completely safe.
Man,There are a few good cops out there, there are cops that try to mess with you and there are just plain assholee cops. And they will lie in court, I saw this first hand in court, the last time Phish played the Hampton coliseum they had all the kids who got busted in court the next day, I was there for my DUI hearing, and one case imparticular they had a 3 kids that were apparently in the same car that got searched and they got minor possession and they were pulling the "we didnt give him consent" thing all three of them and the cops story was classic he said: "I saw the passenger hide something in his pocket, MJ was emmitting heavily from the car, they had red eyes"these kids had no chance the judge gave them some smart ass comment, are you a lawyer he said and gave em a big fine.
My main point just be careful it cost me $1400 dollars last year.
where are these drug dealers that are targeting our kids?? i wasnt targeted in school. its just part of the propaganda war. and some people buy it. if your being a parent then you would know what your kid is up to. and you would know how much money they have to spend and what they are spending it on. and where are these cops that are watching our schools and kids? were they searching a car for pot when columbine got shot up? sh.it, they wouldnt even go into the school to serve and protect our children once they got there and shooting was going on. 3 kids went on a rampage and 50 cops stood outside and went in a couple hours aftet the gunmen shot themselves. and just today the cops let some maniac get out of their custody. he kicked in a door and barged into a house. did the 50 cops on scene follow that armed man in and serve the public that they had put in danger by letting him escape? no they all stood outside and some poor woman had to roll off a second story roof to get to safety. and once she did they they help her get away? no she had to crawl and drag herself to safety. it was on cnn all day. if you missed it they are still showing it. gimme a break. they are worthless. give us back our second ammendment rights and we can protect our own. the way it is now we gotta worry about criminals and cops, which are the same thing. excpept one of them is allowed to violate your rights. our rights were given for a reason. why not use them? they didnt give them to us just to piss off all powerful cops.

^^^well I do aggree cops will stop little crime and are mainly there to clean up afterwards and then apply justice. Not many times do they actually stop crime. DUDE u can go and point out bad things cops do hell we can point out all the bad shit u do.....it' does mean cops are all bad or stupid...cops teach kids about car safety, help many children who have crappy parents find a better life. Cops see kids that are sick in the hospital. Cops help apply justice after a kid is raped. Do u help apply justice? No b/c u don't have the balls to become a cop. Cops find themselves in sutiations everyday u only bitch about while watching T.V. ..it's easy to judge sitting at home sipping a beer. I aggree DUDE protect yourself b/c nobody else will. How about the millions that can't? cops help. i have been in several situations with officers of the law. i have been asked several times to consent to search. sometimes i've had some contraband, other times, i have not. the point is, even when i have nothing in my car, i do not like to have my personal space searched. the constitution protects you from that situation. unless i have a pipe hanging out of my mouth, roach in my ashtray and the like- a cop is not going to search my things. so, unless you have anything in a cop's sight or billowing smoke flying out of your window, there is no reason or need to let an officer search your car. if you know that nothing is in plain sight, tell the officer that you do not consent to search, it may be the best choice you will ever make. after all, an officer's job is NOT to be your friend, but to find people who break the law, arrest, and help prosecute them.

No, I am not a PO nor is anyone in my family. And yes, of course, I have told a lie in my life. Please don't put words in my mouth. I have never lied to a cop though. I just hate to see folks dissing on people that, for the most part, are risking their lives to help us and your families. It's like anything else in this country, only rhe bad things make it to the news. All the millions of good things police do for their community don't make it to the papers or CNN, FOX, or MSNBC.
I have strong feelings about this mostly because my parents were both public school teachers and I think they fall into the same BS police do. All you see in the news is the idiot teachers having sex with students and such and seldom ever hear of the good ones that change lives. They brought me up to respect authority figures and to obey the laws we have. Having said that, I have not follwed EVERY law in my life, but at least I am man enough to take the penalty when I don't. Instead of whining and crying how all police are liars and this law isn't fair.

Are you insane? You seriously believe that police don't do any good at all? And in the same breath you try and claim that drug dealers don't target children? And if your children are doing anything wrong your not a good parent? You live in a fantasy world.
To trash the name of all police officers is like saying all soldiers are evil murderers, which I am sure you are only a step or two away from. I have spent far more than my fair share of time locked up and there are for sure @sshole rule breaking police. Just like there are @sshole rule breaking employees at every job.

Yeah, the world needs police. It's nice to have somebody to call when you find a dead body on the street. The law being fair isn't the material issue here. The issue is whether or not you should piss away all your rights when you're dealing with the police. And whether or not you're doing something wrong, you should never piss away your rights. I love my country (I hate our current administration, but I digress), this country rocks!! You want to know what the neatest thing about this country is? Everyone has rights!! If you are doing something wrong, let the cop break the law to search your car. At least you'll have a very good chance of getting off of it. If you just consent, you'll have to plead guilty. You do not have to make a cop's job easier, and making a cop's job easier isn't going to make your life any easier. It's absurd to think that cops are you going to do you any favors at all. If they're feeling really nice, they might let you catch a cigarette before hauling you in.

If you had something in the car, and you waived your rights and you spend a couple of nights in jail (and you will. You don't have to lie to the cops. There's only two options when dealing with the cops: Tell the truth or shut up. Telling the truth is usually a terrible idea as if you're doing anything wrong you'll incriminatate yourself, so you keep your mouth shut. Not talking is not the same as lying. The cop is not a judge, you don't have to tell him anything. Don't consent to searches. Period. You can sit here and act like there some major consipiaracy between cops, judges, and prosecutors to put small time possession kids in the system, but really there's not. No judge is going to give a cop a warrant to tear your car apart if all he has to go by is "they won't consent to search". If the cop searches your car illegally, no prosector is going to go forward with it. Any schmuck just getting out of law school would be able to get you off the charge. The ghost of Johnny effin' Cochran couldn't do a thing for you, however, if you consented. The cops know all this mess. You should too.

I'm willing to take my licks if/when I'm convicted, not caught. Big difference in my mind. Consenting to a search is a rocket ship towards that conviction I never want to see, IMO.

truer words were never spoken. i have had numerous run-ins with the law in my lifetime (unfortunately) and the only reason cops even ask you questions is because there's no better evidence to use against you than your own words. say as little as possible, while being as courteous and respectful as you can...it's not like you're going to utter some magical phrase that will cause the cop to drop everything and let you go. i've actually had a cop threaten to hit me (pulled back his fist and everything) because i wasn't answering his questions, and in the end i was let go because i kept my mouth shut and didn't say something stupid.
bottom line: your mouth won't save you from anything, so don't use it unless you have to.

Cops are just like all other people, some are really good people, some are really $hitty people, the fact that they are a cop does not put them on a higher or lower moral level than anyone else. The point of this thread is to be aware if your rights, which are guaranteed by the constitution. If you are doing something illegal, be aware of the consequences, and don't do anything else illegal to draw attention to yourself.

You should, of course, never break the law. And you should, of course, be prepared to deal with any consequences that arise from you breaking the law. However, if you are carrying things you shouldn't, yes, knowing your rights could very well save your a$$ and keep you from getting busted. People DO break the law, these people DO have rights, and these people DO have a right to do everything in their power to minimize the damage caused by these encounters. Police are going to do everything they can to catch you, sometimes what they do isn't by-the-book legal or is in direct violation of your rights. If you're doing everything in your power to protect yourself and in doing so you're not breaking any additional laws, simply asserting your government protected rights, what's wrong with that, even if the cop was right and you are breaking the law? The cop is trying to get evidence to convict you, you should do everything in your power not to incriminate yourself. There's is absolutley nothing wrong with this if you ARE breaking the law. You're asserting your rights, and may very well get away with whatever you were doing so long as there is no other evidence. And if the officer wants to search your car, obviously there isn't.
It's true not all cops are corrupt liars. It's also true not all cops are heros. You have no way of knowing. Cops are trained to treat anyone they encounter they do not know about an armed and dangerous felon until they find out otherwise. It's a very good policy, as for all they know they are. You should assume the cop is not going to respect your rights and is going to be a harda$$, because you have no way of knowing whether they will or not. Assert your rights and keep quiet, no matter if you're breaking the law or not.

Well, this thread certainly pushes a few buttons. The only thing I have to say is that if you have illegal materials in your car, don't be a dumba$$ and have them out in plain view for ANYONE to see. Don't drink and drive, smoke and drive, drop and drive, whathaveyou, weave in traffic, speed, drive too slowly...basically anything that could give a cop a wrong idea. I believe there are good cops and corrupt cops. I've been helped by cops before and I'm damn glad they exist. I respect cops. However, I will never give into a search because 1. I don't keep my materials in plain view or partake in said materials if I will be driving. 2. I will not let anyone use materials in my car. 3. I tuck them away so they will be hard to find. I don't want to make it easy for ANYONE to find it.
Don't be stupid. Be a resposible law breaker. (And, we've all broken the law in one form or another.)
