They have reportedly played their final shows with the current lineup. The question is whether the door being open for a different band lineup keeps them eligible.
"The final Swans tour (for this exuberant and heroic iteration of the band) is in its final stages. Of particular interest to me personally are the FINAL 3 SHOWS (AT WARSAW, IN BROOKLYN), since they take place in NYC, the womb wherein Swans was initially gestated. There will be no other East Coast shows surrounding this last stand, and this is it. Finished. I’m pleased here to announce the august and daunting artists that will accompany us on each of these three nights."

On November 2,3,4 the heroic (to us, anyway!) line up of Swans, comprised of Norman Westberg, Michael Gira, Christoph Hahn, Phil Puleo, Christopher Pravdica, Paul Wallfisch, and Thor Harris (Thor will be rejoining us for a few songs) will play our final shows together, at Warsaw, in Brooklyn. That's it. No more performances from this group, ever. Our love for each other surpasses all spiritual, aesthetic, and legal boundaries. It's been about 8 years since we first broke bread and incessantly tested each others patience together in a damp Brooklyn basement, but enough is enough. Following this, I will be rethinking Swans completely. I will continue to make music using the name Swans, with a revolving cast of contributors (and with their kind permission, the above sonic titans will also participate, as their schedules, stomachs, and whimsy allow), but as a fixed group, this, the longest consistent line up of Swans, will be finished. As of November 4 we will have thoroughly devoured each others faces, and little flesh will remain clinging to our brittle bones. And yes, we will be performing these last 3 acts of psychic pugilism wearing pink tutus and black facial polka dots... We will be joined by our honored guests Carla Bozulich, Anna von Hausswolff, and Adult., respectively.

At this point it’s sounding like Gira traded his Angels of Light solo project for the Swans moniker. It’s Gira. It’s gonna be disorienting and weird. It’s just a different cast of characters involved.
One of you need to draft Thor and Friends to open for this shindig.

Can this person who requested the survey be a bit more clear say if he/she wants to draft the last roster of Swans or simply just Micheal Gira?
It would probably be worth it for whoever picks them to note that it's not this last roster and is really "Gira and additional players to named later".
I thought this was just the final tour of this iteration of Swans.

there will be, Dave already went into detail with his post. Swans is basically Michael Gira, but it's still using the Swans name so Swans is still eligible.

I read his post, and I get it, but "swans" played their last show and "other swans" hasn't announced anything. Right now there is effectively no swans, even if gira is planning on coming back as such in '18-19. I really have no dog in this but it seems more of a question to me than Adele.

I don't think this is questionable at all. You just have to accept you're drafting Gira + randoms and not the whole Swans lineup from the last tours.
I'll bite. It was one of the few acts I saw from last year that I could see as possibly off the table. Wanted to clear it up before someone picked them and was left in 6 hr limbo. I have no problem with them being eligible or not.
