Former Phish frontman pleads not guilty Feb 27, 7:54 PM EST
FORT EDWARD, N.Y. (AP) -- Trey Anastasio pleaded not guilty Tuesday to drug charges stemming from a Dec. 15 traffic stop and was released on bail.
The former Phish frontman, of Richmond, Vt., is charged with felony counts of illegally possessing prescription painkillers and driving while impaired. He is also charged with possessing heroin and an anti-anxiety medication prescribed for someone else, which are misdemeanors.
He could get 14 years in prison if convicted on all counts. All the charges, though, carry minimum sentences that involve no incarceration.
Anastasio, who appeared in court to enter the plea, agreed to a pre-plea investigation that will help the court get to know him better "and help you resolve your case," according to Judge Kelly McKeighan.
Attorney Steve Coffey said Anastasio, 42, has a drug problem and is seeking treatment. He attended a 28-day treatment program in January and is attempting to overcome his addiction, Coffey said. "He has a problem, he knows it and is working with it," Coffey said.
Coffey also said Anastasio instructed him not to fight the charges
"He told me `I'm here to face the consequences and work it out with the court and go on with my life,'" Coffey said.
Anastasio and his wife, Susan, left without commenting to a crowd of media.
Why didn't he just plead guilty. Cause then they would have just fined him and put him in rehab. I guess there must be a good reason to plead not guilty. Maybe to get rid of one of the charges or something.
has noone on this board ever been involved with the legal system? unfortunately, i have and an initial plea of 'not guilty' is often times nothing more than a time-delaying tactic to give the defense/prosecution more time to see if they can agree on a guilty plea to lesser charges... Danbird is probably correct.
i'm sure trey has no illusions that 28 days in rehab is going to fix the problem. what it -will- do is give him an opportunity to go through the pains of withdrawal in an environment where he won't be quite as tempted to relapse.

I like that it leaves out the part where it says he was at the Eric Clapton treatment center in Antigua. Couldn't have been too bad.
Anyways, it looks like he'll get out with rehab and fines, which I guess is good, but I hope this makes him realize he can't always be fucked up and he's best with Phish.
The driving while impaired charge might be Trey's biggest obstacle here. It's one thing to have a drug problem. It's another to get caught driving while on drugs, especially painkillers that aren't yours.

i dont understand how he is not fighting the charges and facing consequences by pleading not guilty. wouldnt you plead no contest if that was the case? at any rate im sure it will work out to some fines.

I believe judges tend to be more lenient if you plead guilty instead of no contest. Admitting your guilt and wanting to start recovery/rehab goes a long way in druq court.

ya guilty would have worked too. but not guilty? dosent that usually mean your fighting it?
trey likes drugs and I think his music reflects it
it reflects more on the pyschadelics and pot than in does narcotics. ive seen videos where trey was too narc-ed out to play but ive seen shows with him tripping his balls off and he makes it through (and he still owns it).
The Glens Falls Post Star has reported that the Trey Anastasio case may wrap up on Friday. The paper writes that Anastasio has been offered a plea bargain by Washington County District Attorney Kevin Kortright. The terms reportedly will require the guitarist to plead guilty to fifth-degree attempted criminal possession of a controlled substance after which he will enter a court-supervised, drug treatment program. The Post Star indicates that Anastasio likely will appear in a courtroom this Friday to accept this arrangement so that the court may finalize details.
well looks like its panning out the way most thought it would. nothing serious. which is great news. but if it was me or you we would be screwed.

The 28 Day program is ridiculous of him. 92% of Opiate addicts DO NOT overcome their addiction. You need at least three months in a seclusive center to deal with yourself.
Regardless....I hope the best for Trey. I saw a version of him I had not seen in a while at Oysterhead and GRAB that I would like to see more often. Still, I noticed the dead give-away when he kept scrathing his beard during Little Faces.

yup, hopefully this gives him some kind of a wake up call.
He will be getting the same punishment any 1st time druck offender gets who isn't dealing. He will serve no jail time, he will have to take some sort of druck rehab or druck classes.
FACT: This will actually be Trey's 3rd 28 day treatment rehab. The 2nd one bieng checked into this last January. Now I'm no positive about it, he may have been more times than that. The January one was announced in his public appology. But I met one of his best friends a few months back who went by the name of Fish and although he was so drunk he probably needed to be hospitilized I asked him about Trey's problems and his answer was that he couldn't really talk about it but he said Trey's been trying to get help for a long time now.

^^^^^^^ I hung out with Fishman at a bar he played with those 2 really dirty comedians. It was fun, he was as drunk as Jon Bonham. But it was cool, he kept on hitting on one of the girls we brought with us. Lets just say his wife wasn't pleased. Crazy guy that Fishman!!!
