"A federal judge struck down parts of the revised USA Patriot Act on Thursday, saying investigators must have a court’s approval before they can order Internet providers to turn over records without telling customers.
U.S. District Judge Victor Marrero said the government orders must be subject to meaningful judicial review and that the recently rewritten Patriot Act “offends the fundamental constitutional principles of checks and balances and separation of powers.”
Thank God the courts (at least some of them) still believe in the Constitution. Of course this could still go to Bush's Supreme Court so watch what you say.
But, seriously. This judge could have stood down knowing that an escalation to the Supreme court would be imminent. and that his ruling being overturned would be just as imminent, possibly. But he did the right thing, regardless of what might seem imminent. And he sends a message that it ain't gonna come easy.
A lesson to anyone who fears that voting for a candidate who truly represents them is a wasted vote. Send a message. Gather force.
