Sunday, 08/26/07 Lawsuit: Taxman's bite of marijuana treat too big

A little snap, crackle and marijuana got a concertgoer popped at Bonnaroo.
Now William J. Hoak is suing state officials for over-taxing the confiscated "rice creeper treat," a Rice Krispies treat that contains marijuana. In court papers, Hoak claims the marijuana was taxed based on the weight of the Rice Krispies treat — which includes cereal, marshmallows, among other ingredients — not just the marijuana.
Hoak has been fined $11,506 in taxes, interest and penalties by the state's Department of Revenue for the rice creeper treat, according to the lawsuit.
"It's not like it was a pan of Rice Krispies treats like your mama would bring you," said Jonathan A. Street, Hoak's Nashville lawyer. "It wasn't a large amount of Rice Krispies treats. These taxes are just really high."
Drug stamps are issue Through the state's Taxation of Unauthorized Substances Act, people arrested for illegal drug possession are taxed based on the drug's weight, Street said.
Anyone with illegal drugs can avoid being fined for tax evasion by anonymously buying stamps from the Tennessee Department of Revenue. But possession of the drugs is still against the law, he said.
"It's the penalties for not getting these stamps beforehand that really costs people who get arrested," Street said. "Who in their right mind is going to go into a state building and purchase stamps for their illegal drugs? I'm sure they haven't sold any of them."
(of course there are No druqs at bonnaroo, so I don't know how this happened)

That would be a lot of scum! The war on drugs has so many profiteers it's rediculous. Big Pharma, Agrobusiness, Textiles and paper, the Media (esp. Hearst Publishing), politicians and of course law enforcement and the numerous non-profits who rake in big bucks spreading lies and misinformation about drugs. And don't forget all the labs who conduct piss tests for businesses and the gov't, and of course the drug lords and other black-market big wigs who have no interest in seeing drugs legalized. i agree. it would be alot of people. and the world would be a much better place without them. dont forget the oil and plastics companies. or all of the governents in foriegn countries that let us abuse their citizens in exchange for drug war funding.
EDIT - and i forgot to mention all the people who keep voting for politicians that support this ridiculous war on drugs. which is nearly every poliician out there and certainly all who have ever gotten the nomination from their party for president. which is why ive completely given up on voting. along with our corrupt system for electing a president where most votes dont count for anything.

The problem with that line of thinking is that you abdicate your power as a citizen in a democracy to people who DO vote. Yes politics is corrupt. Yes the electoral college is a fraud. Yes direct action is more effective in the short term, but voting is also important. when you stop voting you're basically saying other people know what's best for you, esp. at the local level.

well i do see some value to voting on a local level. but im to the point where i dont acknowledge any of our government officials or their rules. they can all kiss my ass! i dont really care if they pass a law that says your fined 50 grand if caught with a joint. ill still smoke joints. and if they catch me they can fine me and i wont show up for court. and then they can catch me again and take me to court and assess fines and i wont pay them. and then eventually im sure i would just be another peaceful and harmless person locked up in jail with hardened criminals. hopefully whoever they release to make room for me wont attack my family and go after a judges or politicians family instead. im just gonna live my life by what i think is right or wrong and they can do whatever the hell they want.

Whatever. A cop out like yours is always easier than actually doing something about your situation. "It sucks, I give up." It's exactly what they want you to do: stop paying attention, feel helpless and just accept the status quo as an inevitablility. You know, there was a time when Marijuana was legal. If that's what your so passionate about, why not work w/ NORML and work toward change rather than giving up and letting sh!t remain the same. There actually ARE a few pro-marijuana candidates, but you'd never know it and they'd never get the support they need b/c people like you are at home hittin the bong playing Halo instead of getting off your lazy ass and spending a few mins voting. It's not like its difficult or expensive.
As long as people like you, who have legitimate gripes w/ the system, sit around and bitch instead of organizing, making your voices heard and weilding some political clout as a VOTING block, you will continue to gripe like Cartman and pretend you are outside the system until someone comes along and takes your freedom away. Then you can do your anti-social bitching in prision while Activists (and the key word here is ACTIVE) try to save your ungrateful ass.

Yea it was a little harsh.....but (not speaking directly to Dude here) it is along the same lines when people sit around and complain about how bad their job is and how bad their company sucks or how it sucks they only make 7.50 an hour at McDonalds when they chose not to go to a technical school or college.
It's easy to throw your hands in the air and say "I can't do anything about it" then go on to bash the people that are "victimizing" you. People that sit around and complain about being the victim all the time are seldom, if ever, the ones with enough guts and drive to go out and try and change their situation.
I was referring more to the direct personal attack on dude, rather than what he actually said. I agree with everything stallion said as far as getting out and doing something. But damn, that was harsh on the dude!

Al Franken defined two types of "mean," "fair mean" and "unfair mean." I think my comments fall under "fair mean." I don't think anything I said was unfair or unwarranted. Harsh, maybe, but not unfair.

its all good. ive been known to be slightly harsh too. and for the record i have been to quite a few pro legalization rallys. ive signed the peteiitions to get marijuana initiatives on ballots when i was registered to vote. and ive donated money to norml probably a dozen times. could i do more? sure. who couldnt? i look at it this way. if someone wants to play a game of basketball that the outcome has huge worldwide implications but the game will be at their house, they get the ball after every made basket by either team, im not really allowed on their court except for possibly a step inside out of bounds very infrequently, the ref is there best friend, the score keeper is their little brother, there is no oversight whatsoever of the ref or the scorekeeper and even if i score more points i may not win because they have some crazy system of making over half of the points worthless then id say no thanks. why waste my time and energy?
the reason that the pro marijuana candidates get no notice is because its their (dems and repubs) court and they arent allowed to play on it. and instead of saying fuckit im dropin out too many people just support some dipshit so they can live the illusion they are making a difference. what a joke. or they say well this guy is against most of what i believe but hes got a chance to win so ill vote for him. if you cant beat em join em i guess. whatever works for ya.
and you can go through the public school system that trains you to put up with extreme boredom and repetition so you can become a part of the machine. and now theyve got ADHD and all this other bullshit so that when yer slave class job makes you so bored and unhappy you wanna kill yourself you will be used to using druqs to get through it. and dont forget all the money you give to the machine for those druqs. you can go to trade school and become a part of the slave class so you can achieve the american dream. ya right. its an illusion. and its an illusion i see past and want no part of. and anyone who lives the illusion and fully participates in it like they have any effect on it whatsoever is dilusional. but hey more power to ya. i hope ya pay your taxes from your slave class job to support your machine like a "good american". and lucky for them after you become a part of the slave class you wont have the money to send yer kids to a university perpetuating the slave class and giving them ripe targets to get into the military to go fight their illegal wars. its just not the life for me. i dont just sit around and bitch. i live my life. i have a shitload of fun with friends and family. i dont pop a bunch of anti-depressants so i can spend 40 hours a week in an office or factory for 50 years so i can have some illusion of achieveing something through possesions. but hey all the hampsters can run the maze and get in that wheel and run run run for the man. someones gotta do it. some people are cut out for it and others arent.

i do landscaping off and on in the summer when i dont have enough money to be at a fest. i ran out of money a bit early this summer ;( damn responsibilities. and snowplow in the winter. i also have a badass hook up answering customer service calls from my house all winter. i know the man in charge so i get a double job. so 80 hours a week from home all winter. and of that 80 hours im maybe working about 10 hours the rest is just having to be here for when that phone rings. which means lots of smoking, drinking, music, sleeping, and xbox live. all the jobs i work are paid to me in full and im responsible for paying my own taxes. i wont go into how much of that i actually do on the internets. but let me just say that the irs is a horribly unorganized and overworked bunch of baffoons. i know people who havent paid taxes in decades. i even know people who have claimed kids that are already legaly claimed by someone else. its a big bonus and the irs may send letters to them but its 3 years after they send out the check and they never follow up on it. and they can only do that if you live at the address the man has you listed at. you have to pay taxes on gas and sales tax, but income tax is pretty much an option here in america. unless your making an absolute shitton of money they dont notice and/or dont care. so i work what can be considered slave class jobs but i certainly dont do it the enslaved way. its worth my while. althgouhg i must admit i feel enslaved to my house all winter. but its worth it for the money i get and lit lets me do my sumer the way i want. granted im not getting any fat retirement package but after a couple of decades of hitting fests all summer i dont think ill have to worry much about getting old enough to retire.
I certainly don't disagree with a lot of what you have to say. I'm just trying to point out that alot of us work for the man, one way or another. Unless you're some sort of artist with many patrons, or you're lucky enough to have your own business, then you're probably earning your dollars working for the government or some sort of corporation. MANY people don't have any choice if they want to survive, so you should rethink your slams about the slave-class and our "american dream". It's certainly not MY american dream. It's all I can do to strive for change while I put in my time making sure my family survives.

i would be really interested in hearing how much of a fine that pig with 2 ounces from roo in his house got for that. hopefully some obscene amount. and some drug counseling programs that cost hundereds of dollars, some court costs, and probation with piss tests. and of course he should lose his job for having such a dangerous and horrible substance around. but im betting he got nothing.
