and a victimless crime is just like it sounds. its crime without victims. if i take some herb to roo and smoke it im not harming anyone. if some dude brings a bunh of shrooms and herb to roo and sells tehm to adults its not harming anyone. if some dude wants to get a hooker hes not hurting anyone. if a woman wants to sell her body its not harming anyone. if you want to place a bet on the game its not harming anyone. there are no victims. and in the ultimate act of hypocrisy its ok to get a hooker in nevada, but not everywhere else. its ok to bet on the game in vegas. but not anywhere else. its ok to smoke herb in some states with medical use laws. its ok to smoke cigarettes and make tax payers pay for your medical treatment later in life. not to mention the second hand smoke everyones exposed to. drinking isnt illegal. as long as your 21. you can fight and die for your country but godamnit ya better not have a beer. hey mip's bring in money. victimless crimes are a waste of time. yall could have been investigating those guys who entered the country while on the terrorist watch list and flew planes into buildings. you could have investigated those kids that were out in the woods shooting assault rifles and blowing up homemade bombs before the attacked a school full of kids. and yall could have went into that school. 3 kids with guns slaughterd defenseless children because the dozens of cops with guns trained to deal with stuff like this decided to hide outside until they decided they were done killing and shot themselves. secure our borders. start preventing crimes instead of just looking for money waiting for something to happen and then responding to it in a half ass way.

so you'd have it that discretion be totally out of the question. i think that may be one of the most important powers we have. also, at least in tn the laws other than a couple are written that upon an infraction an officer may arrest. that tell me discretion is mine to use. how many people do you think get stopped and it never goes to a line of questioning. i'll help you out with that one, it's about 75 - 80 percent. the other 20 -25 there is something that makes the officer think that maybe there is more to the story than what meets the eye. and as far as it making me untrustworthy, i've always felt that jamming somebody up isn't the only way to do your job, guess my whole outlook is wrong. with the new outlook you've given me i'll triple the arrests i make and become trustworthy all at the same time.

exactly! so hes not doing his job an a couple of levels. hes violating my constitutional rights. and then hes letting me get awy with law breaking. it worked out nicely for me. dosent mean hes someone i should respect. he violated my rights. and becasue he did that he was able to steal my smoke. and letting me off does mean hes not doing his job. its a pretty clear oath to uphold and enforce laws. no where does it say uphold and enforce laws at your discretion.

what is discretion? the laws regarding our rights clearly state that reasonable cause mus tbe determine to warrant a search. it dosent say well if the officer has a hunch its ok to for go the rights. its stated that if soemthing is in clear view. if the ofiicer has direct proof soemthing illegal is in the car thats reasonable cause. it says nothin about hunches or discretion.

Again are you sure that police are not allowed to use discretion? Show some proof instead of pretending you know the laws.

Discretion is the officer a week ago that didnt give me a ticket for running a stop sign, not having my proof on insurance, and not wearing a seatbelt.
Its also the officer that took my herb when I was 16 at a music fest dumped it on the ground and smashed it with his foot then told me to get lost.
Its also the cop that let you go instead of actually arresting you.
up to discretion to make an arrest or not, that was the part where i said the law says may arrest. just like giving a warning is using discretion. can you imagine what it would be like if we enforced every singe infraction we are aware of? wouldn't be a good place.

and they do that becasue its illegal. drugs wouldnt cost an arm and a leg if they were legal. people are paying 20 dollars a gram for something you can grow in your backyard. and just like with alcohol prohibition, as soon as its ended the violence goes away. the violence is only there becasue our laws make it a hugely profitable black market. and the money in that balck market is what is funding terrorism. alqueda and the taliban collected 4 billion in the poppy trade becasue its illegal. make it legal and that wouldnt be worth shit. and its just some myth that if druqs were legal we would be over ran with dangerous druq addicts. its laughable. if crack, meth, and h became legal tommorow would you start using? no. i wouldnt either. and addicts could pick up some cans and get a fix instead of having to commit crimes to get their fix. and if we quit locking up druq offenders we migth have room to keep all of these child predators that get put out on the street to prey on our children. are the cops wathcing those guys who should be in prison? no they are hassling someone over some pot.

Also your argument for no drug crime if it were legal is beyond laughable. Have you ever heard of Mexico? Have any clue how many murders happen there due to drugs? You act like drugs are harmless aside from dealing with police.

But even then you can face seizure of your house, vehicle, bank accounts, etc. And spend 15 grand or more to defend yourself. Perhaps you get aquiited in court. How much of that money/property comes back ? How much of it goes to fund the continuation of this harassment ?
And unless the ACLU can make a benchmark case out of your situation, they don't want anything to do with you.
